How to Handle Life Insurance Following Divorce

A marriage is meant to last until death but sadly it does not always work out that way. Now if during your marriage you did the responsible thing and bought life insurance you now have some things that you need to decide. Because life insurance keeps on covering no matter whether or not you are divorced or not, you will need to figure out how you are going to handle such things. This is all very basic but it has to be done nonetheless and it may involve having to speak with and meet with the ex to get some things settled. The standards that are set down need to be revamped when it comes to life insurance and divorce and it all really depends on whether or not the divorce was amicable or not.

For those that get a divorce and remain on friendly terms with their ex the handling of the life insurance may be very easy. The beneficiary is the main thing that needs to be taken care of. There are many people who have gotten divorced and kept their ex on as the person that will receive the money. This is not uncommon for people who have decided that the marriage was just not working and left it as friends. With that in mind they still trust each other enough to remain the beneficiary of the life insurance policy.

The issue of people that remain each others beneficiary after divorce also depends on whether or not one or the other gets remarried. This is a situation where the policy would then be switched over to the new spouse in most cases. This is not the case though if there are minor children involved. 

Having minor children and divorcing is hard as it is, but when you add life insurance into it there are other aspects that need to be discussed. The minor children need to be cared for and the life insurance policy is the way to do so.  In this case it is best to leave the beneficiary as the ex-spouse but with the stipulation in a will that it is to be used to care for the children. Most often this is not a problem for the people involved and the children are foremost in their minds as it is. This is a good thing to discuss with your ex before making the change so that everyone involved remains on the same page.

If your divorce was a bitter one then you may need to enlist the help of a lawyer. There are ways to make sure that the life insurance that you have is protected but you will need to be sure that all of the paperwork is in order. The help of a lawyer will be invaluable in this situation.
